1. About Fab New Home

Fab New Home (fabnewhome.co.uk) is an online marketplace. We bring together homeware, gifts and accessories from independent brands and suppliers (“Sellers”) and present them in one place. Products listed on the site are supplied by those Sellers, and we arrange the ordering, payment and customer service on their behalf.

When ordering opens, your order confirmation email will set out who your order is supplied by and how it is fulfilled.

2. Using the site

By using this website you agree to these terms. We may update them from time to time; the version shown here at the time you place an order is the one that applies to that order.

3. Orders

We are not yet accepting orders. Once ordering opens, placing an order is an offer to buy, and a contract is formed when we email you to confirm your order has been accepted. Orders are subject to availability, and we may decline an order — for example if an item is out of stock or has been listed at an obviously incorrect price. If we cannot fulfil your order we will tell you and refund any payment in full.

4. Age-restricted products

Some products we sell contain a knife or blade, such as cheese knives, knife sets and cutlery sets that include a knife. It is illegal to sell knives and bladed articles to anyone under 18, so these products are marked “Age restricted — 18+ only” on their product page and can only be bought by customers aged 18 or over.

Age-restricted products can’t currently be bought through our online checkout. If your basket contains one, you can send us an enquiry from the checkout page instead, confirming that you are 18 or over. We will contact you by email to arrange the order, and we will ask you to prove your age (for example with a passport or driving licence) before we accept it. Sending an enquiry does not form a contract and no payment is taken at that stage.

We will not accept or fulfil an order for an age-restricted product unless we are satisfied that you are 18 or over. Age-restricted products must be delivered to, and signed for by, a person aged 18 or over, and proof of age may be requested on delivery. If proof of age is not provided, the item will not be handed over and will be returned to us, and we will refund you. We may also cancel and refund any order where we reasonably believe the product is being bought for, or will be given to, someone under 18.

5. Your account

You can check out as a guest or create an account. If you create an account, you are responsible for keeping your password confidential and for activity on your account. You can view your orders and update or delete your account at any time from the “My account” page. Deleting your account does not cancel orders already placed, and we keep order records for as long as the law requires.

6. Prices and payment

Prices are shown in pounds sterling (GBP) and are the total price you pay for each item, including any VAT the Seller charges. Delivery charges are shown before you pay. Payment is taken securely at checkout by our payment provider; we never see or store your full card details.

7. Delivery

We only ship to addresses in the United Kingdom (England, Scotland, Wales and Northern Ireland); we cannot deliver outside the UK, including to the Channel Islands and the Isle of Man. The delivery options, their prices and any free-delivery threshold are shown at checkout and on our delivery & returns page. Estimated delivery times are not guaranteed.

8. Cancellations and returns

Your 14-day right to cancel. Under the Consumer Contracts Regulations 2013 you can cancel your order within 14 days of delivery without giving a reason. We refund the price of the items and the standard delivery charge (not the extra cost of a faster delivery option you chose). You pay the cost of returning the items. We may reduce the refund if an item has lost value because it was handled more than necessary to check it.

Our 30-day returns. In addition, you can return unwanted items between 15 and 30 days after delivery. These returns have a restocking fee of 25% of the item price, and you pay the return postage.

Unwanted items must be unused, in their original packaging and in a resellable condition. Some items are marked as non-returnable (for example, reduced items with visible marks or damaged packaging). None of this affects your rights if an item is faulty, damaged or not as described: those are never charged a restocking fee and you won’t pay to return them.

Returns go back to the Seller who supplied your item, not to Fab New Home. To return something, use Request a return on your order page; you’ll then be shown (and emailed) the Seller’s returns address. Refunds are made to your original payment method within 14 days of the Seller receiving the items (or evidence that you have sent them back, if earlier). 9. Faulty items and guarantee

Your statutory rights under the Consumer Rights Act 2015 are not affected. If an item arrives damaged or faulty, message the Seller from your order page (or contact us) and a repair, replacement or refund will be arranged. Products also come with a 12-month guarantee against manufacturing defects, in addition to your statutory rights.

10. Product information

We take care to describe and photograph products accurately. Colours can vary slightly between screens, and handmade or hand-painted items may differ a little from the photos. Measurements are approximate.

11. Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable. Nothing in these terms limits liability that cannot be limited by law.

12. Privacy

We handle your personal information as described in our privacy policy.

13. Law

These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you may also bring proceedings in your local courts.
